Procedures of Shanghai Municipality on the Use and Management of Funds for the Development of the Service Industry 

 

Chapter One General Provisions 

 

Article 1 (Purpose and Basis) 

 

According to the city’s overall requirements for accelerating the construction of “five centers”, further consolidate and play the main role of the service economy in national economic and social development, comprehensively improve the overall quality and energy level of the service industry, and give full play to the guidance of financial funds. To improve the development environment of the city’s service industry, guide social funds to increase investment in the service industry, further improve and regulate the use and management of Shanghai’s service industry development guidance funds (hereinafter referred to as „guidance funds“), and formulated in accordance with the spirit of relevant national documents This approach. 

 

Article 2 (Source of Funds) 

 

The guidance funds are arranged by the local fiscal budget and are earmarked as subsidies for the development of the city’s service industry. 

 

Article 3 (Support Object) 

 

The target of the guidance fund support is legal persons and unincorporated organizations (except branches) established in this city according to law. The project unit should have a reasonable economic scale, a good credit record, and no violations of laws or regulations. 

 

Article 4 (Administrative Promotion Department) 

 

The review team is composed of the Municipal Development and Reform Commission, the Municipal Economic and Information Technology Commission, the Municipal Commission of Commerce, and the Municipal Finance Bureau, which is responsible for guiding fund application acceptance, evaluation management, review and approval, and supervision and inspection. The office of the review team is located in the Municipal Development and Reform Commission. Relevant departments in each district are responsible for the management of the district’s guide fund project library and the preliminary review of the declared projects; responsible for the supervision of the funds during and after the event, and the promotion of the implementation and acceptance of specific projects and other daily management work. The municipal department in charge of industry is responsible for recommending to the review team major service industry projects with demonstrative and leading roles in the industry, and cooperating with districts to do a good job in guiding funds during and after supervision. 

 

Chapter 2 Scope of Use and Support Methods 

 

Article 5 (Scope of Use) 

 

Guidance funds are mainly used to support project construction, business development, and research on major issues in weak links, key areas, key areas, and emerging industries in the development of the service industry, and cultivate „new technologies, new formats, new models, and new industries“ in the service industry , To promote the internationalization, marketization, socialization and scale of the service industry. 

 

Mainly used in the following areas: (1) Supporting the „Thirteenth Five-Year Plan for the Development of Shanghai’s Service Industry“ (Hufufa [2016] No. 65) and the „Outline of Service Industry Innovation Development (2017-2025)“ (Development and Reform) Planning (2017) No. 1116) service industry projects in clearly focused areas. (2) Support the „Shanghai Municipal People’s Government on the implementation of the „Guiding Opinions of the State Council on Accelerating the Development of Producer Services to Promote Industrial Structure Adjustment and Upgrade“ (Hu Fu Fa [2015] No. 27) in the key areas specified Service industry projects. (3) Support the service industry projects in the key areas specified in the „Several Opinions of the Shanghai Municipal People’s Government on Promoting the Development of the Municipal Service Industry“ (Hu Fu Fa [2014] No. 59). (4) Support key service industry projects in the pilot area of ​​comprehensive reform of the national service industry, the national public entrepreneurship innovation demonstration base, the national service industry demonstration park and the city’s service industry innovation development demonstration zone. (5) Support the study of major strategies, major policies and major issues that promote the development of the city’s service industry. (6) Support the construction of various service industry parks with demonstrative and leading roles, and provide funding for planning and demonstration of their core regional development strategies, industrial development, and functional positioning. (7) Support the development of service trade, service outsourcing, and cultural and creative industries. Specific support measures will be formulated separately. (8) Other matters requiring support upon approval by the municipal government. 

 

Article 6 (Method of Support) 

 

Guide funds to adopt the method of classified support. 

 

(1) Major demonstration projects: Projects with a total investment of more than 30 million yuan (inclusive), which have an important demonstration and leading role in the development of the city’s service industry, and feature advanced technology and model innovation, are supported by municipal and district guidance funds . 

 

(2) Key projects: projects with a total investment of more than 10 million yuan (inclusive) will be supported by city and district guidance funds. 

 

(3) General projects: projects with a total investment of less than 10 million yuan will be supported by district-level guidance funds. 

 

Total project investment refers to the amount of project investment approved by the intermediary agency entrusted by the review team. The support of municipal guidance funds is arranged and used in the form of free funding, which is mainly used for equipment purchase and installation, software development, technology transfer, personnel training, system integration, design consultation, research and development testing, qualification certification, etc. Explore the funded operation and management model of guiding funds, combine the investment of venture capital and other market funds in enterprises or projects, appropriately simplify the review process, study support methods such as follow-up investment, and further amplify the leading and leading role of financial support for the development of the service industry. 

 

Article 7 (Supporting Standards) 

 

For major demonstration projects, the amount of municipal guidance fund support shall not exceed 6 million yuan in principle. Among them, for major functional service industry projects in the city that need to exceed the upper limit of support, the review team will study and determine the amount of support. For key projects, the highest municipal-level guidance fund support ratio does not exceed 20% of the total project investment, and the amount of support does not exceed 3 million yuan. 

 

Article 8 (District-level support) 

 

In principle, the districts where major demonstration projects and key project companies that have received municipal guidance funds are located should be funded at a ratio of no less than 1:1 with municipal support; Jinshan District, Fengxian District, and Chongming District should be supported by funds. Outer suburbs can arrange funds to support them at a ratio of no less than 1:0.5 to municipal support. 

 

Each district shall formulate relevant regulations on the management and use of district-level guidance funds, and provide support for service industry projects with a total investment of less than 10 million yuan. 

 

Chapter III Project Application and Review 

 

Article 9 (Project Library Management) Each district shall establish a project library for guiding fund budget management (hereinafter referred to as the „project library“), evaluate the declared projects and incorporate them into the project library, and follow-up management and implementation of the projects included in the project library. 

 

Article 10 (Preliminary Review and Reporting) 

 

Relevant departments of all districts shall be responsible for the preliminary review of projects in accordance with these Measures for the projects that have been included in the project database, and entrust intermediary agencies to conduct preliminary screening of the declared project materials through expert review and other methods, and strictly control. Projects that have been arranged to support municipal financial funds will not be accepted. 

 

For the major demonstration and key projects that have passed the preliminary review of each district, the relevant departments of each district shall submit the application for guiding funds to the review team office twice before March 31 and August 15 each year, and provide the following main attachments: 

 

(1) Summary table of application for guiding funds. 

 

(2) The preliminary review conclusion of each project. 

 

(3) Application form for each project and related attachment materials. 

 

The relevant departments of each district are responsible for the compliance and legality of the submitted application materials. 

 

Article 11 (Approval Procedure) 

 

For the application materials submitted by the relevant departments of each district, the review team is responsible for entrusting intermediary agencies to conduct comprehensive assessments through expert review and other methods, review the assessment results, publicize the projects to be supported online and consult the municipal industry authorities. For projects reviewed and approved by the review team, the Municipal Development and Reform Commission and relevant departments shall issue guidance fund support plans to each district. 

 

Article 12 (Funds Appropriation) 

 

After review and approval of the project by the review team, the relevant departments of each district and the project unit signed the „Shanghai Service Industry Development Guiding Fund Project Implementation Framework Agreement“ and reported to the review team, the Municipal Development and Reform Commission submitted an application for fund allocation to the Municipal Finance Bureau. The Municipal Finance Bureau shall allocate funds in stages in accordance with the relevant regulations on the management of fiscal capital budgets. After the guidance fund support plan is issued, the first payment shall be made, which in principle shall not exceed 40% of the scheduled support amount. After the project is completed and passed the acceptance check, the remaining funds will be allocated. 

 

Chapter 4 Project Management During and After the Event 

 

Article 13 (Supervision in the Process) 

 

In the process of guiding funds to support the project implementation, the project unit shall report the project implementation status to the relevant departments of each district quarterly, including the project construction content and implementation site, project investment, implementation progress, team building, organization and management system, unit overall operation and guidance Use of funds, etc. 

 

Relevant departments of each district are responsible for the ongoing supervision of the project, the promotion of specific daily management work such as the implementation of the project, and the report of the project implementation status and the use of guidance funds to the review team every quarter. 

 

Article 14 (Tracking Service) 

 

(1) For major demonstration projects, the relevant departments of each district are responsible for advancing the implementation of specific projects and supervision during and after the event. Members of the review team and relevant departments participate in the whole process management of the project, and jointly promote project construction with each district. For major problems encountered by the project unit in the daily operation process, the review team will provide follow-up services and actively coordinate and promote. 

 

(2) Key projects. The relevant departments of each district are responsible for advancing the implementation of specific projects and supervision during and after the event. Strengthen the follow-up service of supported projects, keep abreast of the progress of the project, and report the relevant situation to the review team in time if there are major changes in the implementation of the project. 

 

Article 15 (Project Acceptance) 

 

After the project is completed, the project unit shall submit an acceptance application to the relevant departments of each district within six months. As the department responsible for project acceptance, the relevant departments in each district shall formulate relevant acceptance procedures and methods in accordance with the city’s project acceptance management requirements, and conduct acceptance within one year after the project is completed (completion). 

 

Article 16 (Project changes) 

 

If a major change occurs during the implementation of a project supported by the guidance funds, the project unit shall promptly submit an application for change to the relevant departments of each district, and shall not change without authorization. Relevant departments of all districts shall submit relevant materials of project changes to the review team. Under any of the following circumstances, it shall be deemed as a major change in the project: 

 

(1) The project legal person changes. 

 

(2) The construction site has changed. 

 

(3) The main construction content and nature of construction have changed. 

 

(4) Significant changes occurred during the construction period (generally referring to a delay of 1 year or more). 

 

(5) The total investment is reduced by 20% or more. 

 

(6) Important changes in other regulations. 

 

If project changes result in a change in the amount of guidance fund support, the review team shall withdraw the excess support of the guidance fund within a time limit. 

 

Article 17 (Project Cancellation) 

 

Under one of the following circumstances, the relevant departments of each district shall submit an application to the review team office to cancel the guidance fund support project. After the review team has discussed and approved it, the review team will withdraw the allocated guidance funds within a time limit. 

 

(1) The project implementation conditions have undergone major changes, causing the project to be unable to continue implementation. 

 

(2) The project unit changes the construction content and objectives of the project without the approval of the application. 

 

(3) The project construction period expired 6 months, and the application for acceptance or extension was not submitted in time. 

 

(4) The project still cannot be completed on time after 2 years of delay. 

 

(5) Other circumstances in which the project should be cancelled in accordance with laws, regulations, rules or regulatory documents. 

 

Chapter V Other Matters 

 

Article 18 (Supervision and Management) 

 

The relevant departments of all districts shall make timely summary of the development of the service industry, the use of guiding funds, project implementation, and project acceptance, and form an annual summary report on the use of guiding funds, which shall be submitted to the review team by the end of February each year. The review team is responsible for the comprehensive assessment of the annual guidance fund use summary report of the relevant departments of each district, and adjust the arrangement of the guidance fund for the next year based on the review results. 

 

After evaluation, for districts with outstanding performance or districts that have not met the standards and are not effective in rectification, appropriate adjustments will be made to the funding arrangements for the next year. The review team, in conjunction with the Municipal Audit Bureau, the Municipal Industry Competent Department and other departments, supervises, audits and inspects the use of guidance funds and project implementation in accordance with relevant regulations, and commissions professional institutions from time to time to carry out guidance funds use and post-management evaluations. Implement project performance management and other tasks. 

 

Article 19 (Administrative Expenses) 

 

Through the government’s purchase of services, the review team entrusts professional institutions to carry out municipal-level guidance fund project evaluation, post-evaluation, audit, performance evaluation and other related expenses, which are included in the guidance fund. 

 

The district-level finances shall settle the relevant expenses of the preliminary review and evaluation of the district-level guidance fund project, in-process supervision, and acceptance audit. 

 

Article 20 (Accountability) 

 

Guidance funds must be earmarked. For projects supported by guiding funds, the main construction content and construction standards shall not be changed without authorization. For fraud, detention, embezzlement and other violations of laws and regulations or relevant disciplines, in addition to imposing relevant penalties on the project unit and relevant persons in charge in accordance with national regulations, the allocated guiding funds shall be recovered within a time limit, and the project legal persons and project leaders shall be cancelled within three years Declare the qualifications for this special fund, etc. 

 

Article 21 (Credit Management) 

 

The review team conducts credit management on the project unit. In the project application stage, implement a trustworthy commitment and credit review system; establish a credit information management system to record the untrustworthy behavior of the project unit at different stages of project initiation, implementation, acceptance, and evaluation, and provide the municipal public credit information service in accordance with relevant regulations Platform; for serious dishonesty or illegal acts such as tax evasion and tax evasion in the past three years, the legal person and person in charge of the project will be disqualified from reporting the special funds within three years. 

 

Chapter VI Supplementary Provisions Article 22 (Supplementary Provisions) 

 

The use of special funds for service trade, service outsourcing, and cultural and creative industries shall be managed in accordance with relevant management measures. These Measures will be implemented from April 1, 2018, and will be valid until December 31, 2022.
